He was arraigned on January 2 before the Sagamu magistrate court, with Magistrate Olufunilayo Somefun presiding. Kayode is facing a four-count charge, including dangerous driving causing death, contrary to Section 5(1) of the Federal Highway Act, Cap F: 135, Laws of the Federation of Nigeria, 2004, as applicable in Ogun State.

Other charges include reckless and negligent driving under Section 6(1) of the Act; driving without due care causing bodily harm and property damage under Section 7(1); and driving without a valid national driver’s licence under Section 10(1) of the Federal Highway Act.

During proceedings on Tuesday, the prosecution, led by Nijiwe Richard, requested an adjournment to duplicate the case file for transmission to the Ogun State Attorney General’s office through the Department of Public Prosecution for legal advice. The defence, represented by Abiodun Olalekan, opposed the application, insisting they were ready to proceed.

Magistrate Somefun granted the prosecution’s request, adjourning the trial to February 25. The court also granted Kayode bail in the sum of N5,000,000 with two sureties.
