An Ogun State High Court sitting in Sagamu has issued an interim order preventing the Ogun State government and its agents from demolishing or tampering with property owned by former Ogun State Governor, Otunba Gbenga Daniel

The ex parte order followed an affidavit of urgency filed by Otunba Daniel and his wife, Yeye Olufunke Daniel.

On July 8, 2025, officials from the State Ministry of Urban and Regional Planning, through the State Planning and Development Authority, posted Notices of Contravention, Quit, and threats of demolition on the former governor’s private residence, Asoludero Court in Sagamu, as well as Conference Hotels Limited and its annex—all located in Sagamu.

The State government, in a letter dated August 8, 2025, alleged that some buildings were constructed without planning permits and proper setbacks.

In suit number HCS/371/2025, the court held that immediate intervention was necessary to protect the property pending further hearing.

The judge ruled that the defendants, including their agents, allies, proxies, assigns, and any persons acting on their behalf, are barred from carrying out any demolition, enforcing the quit notice issued on August 8, 2025, or otherwise interfering with the claimants’ possession of the property.

The property covers about 1.659 hectares, comprising Block 1, Plots 7 and 8, and Block XXXVIII, Plots 1 and 12, within the Government Reservation Area (now Awolowo Avenue) in Sagamu. It is covered by Certificate of Occupancy No. LUD3/LR2693, issued on January 20, 2010.

The court also restrained the defendants from trespassing or disturbing the claimants’ peaceful possession of the property until the substantive motion on notice is heard and determined.

In her ruling, the judge stated:

“Hearing the affidavit in support and the affidavit of urgency, I find it necessary for this court to intervene immediately. I hereby issue an ex parte interim order restraining the defendants, their agents, proxies, assigns, cronies, servants, or any person acting on their behalf, from demolishing or tampering with the property known as Asoludero Court, located at Block 1, Plots 7 and 8, and Block XXXVIII, Plots 1 and 12, within the amended Government Reservation Area, Sagamu (Awolowo Avenue), measuring approximately 1.659 hectares, pending the hearing and determination of the motion on notice.”

She also issued an interim injunction restraining the defendants and their agents from further trespassing or disturbing the claimants’ quiet possession of the property.

Regarding the suit filed by Conference Hotels Limited, the judge said:
“I am satisfied that urgent court intervention is necessary. Therefore, I issue an interim order restraining the defendants and all acting on their behalf from demolishing or tampering with the property purchased by the claimants from Segun Adesanya, who acquired it from Captain Kamoru Olatunde Alaba, who in turn bought it from the original allottee, Mr. Josiah Funso Ayankoya. This order is pending the hearing and determination of the motion on notice.”

On the suit filed by Conference Hotels Limited and Blue Chapel Limited, the judge added:

“Having reviewed the supporting affidavits, I find there is an urgent need for intervention. I hereby issue an ex parte interim order restraining the defendants and those acting through them from demolishing or tampering with the property covered by Certificate of Occupancy dated April 8, 2004, registration No. 51 at page 51, Volume 612, pending the hearing and determination of the motion on notice.”

The court adjourned the hearing for the interlocutory injunction application to August 19, 2025.
