Sia’s estranged husband is requesting full custody of their child, whom they welcomed in March 2024
On Monday, Oct. 27, the Reasonable Woman artist’s estranged husband Dan Bernad filed for sole custody of the couple’s child, Somersault Wonder Bernad, 19 months, who they refer to in the court documents as “Summi.”
In the documents obtained by PEOPLE, Bernad alleged in the documents that the 49-year-old is “an unfit and unreliable parent struggling with substance abuse and addiction.”
In Sia’s responsive declaration, filed on Tuesday, Oct. 28, and obtained by PEOPLE, she claimed she’s been sober for six months.
“I have been fully sober for over six months and working my program which includes weekly testing and a sober companion,” the filing read. “My recovery has been a cornerstone of my life and one of the primary reasons I chose to separate from Dan, whose ongoing engagement in a nightlife and recreational drug-use lifestyle is incompatible with a healthy environment for our child.”
Elsewhere in the court documents, Bernad alleged that the musician did not take a “primary caregiving role” with their son, adding that she “delegated nearly all child-rearing responsibilities to a revolving team of nannies while she maintained control from a distance.”
“This dynamic in Sia’s house and the control she exerted put Summi at the center of a one-sided and highly managed environment,” Bernad claimed. “To my knowledge, this has not changed since I moved out of the house. In fact, Sia’s nannies have handled every single custodial exchange since the start of the divorce.”
Bernad alleged that there were always a lot of people in the house, including staff members and collaborators, and friends of Sia, who were “competing for time with Summi, and, consequently, infringing on my time with our son.”
In response to his claims, Sia alleged that her son “has always been in my primary care and custody,” adding that Bernad has never “had custody of Summi for more than two hours at a time and [was] always monitored” from the onset of a criminal investigation for possessing child pornography by the LAPD and the Department of Child and Family Services.
While she acknowledged that she understands that the investigations have been inconclusive and closed, she stated that it “does not appease my concerns of Summi spending unsupervised time with Dan.”
“Furthermore, given Dan’s lack of prior experience and time with Summi and Summi’s very young age at 1.5 years old, it is not in Summi’s best interest to have any custody arrangement other than a gradual step-up in time with an experienced childcare provider present,” Sia claimed.
Bernad denied “any involvement with this alleged contraband.” The investigation centered around a hard drive containing inappropriate images, which Bernad claimed that Sia “planted” to restrict his time with their son. He claimed that he “never even visited the storage unit” where Sia’s assistant and friend Hayley found the hard drive, alledging that Sia and her employees acquired it.
In addition to sole custody, Bernad is requesting Sia to submit to regular drug testing, enroll and participate in co-parenting classes for six months and have monitored visitation three times per week for two hours.
Bernad, who claimed that he is currently unemployed and doesn’t have an income, is also asking for $77,245 per month in child support and for her to be fiscally responsible for all uninsured medical expenses, extracurricular activities, tuition and childcare costs.
