Senator Natasha Akpoti-Uduaghan, representing Kogi Central, has threatened to take legal action against the Clerk of the National Assembly, Kamorudeen Ogunlana, if she is not allowed to resume her legislative duties by Monday, September 15, 2025

The warning came in a letter dated September 10, signed by her lawyer, Michael Numa (SAN.

“Take notice that failure to comply by Monday, 15th September 2025, will leave us with no alternative but to initiate proceedings against you personally and in your official capacity,” the letter stated.

Numa said any legal action would focus on the CNA’s alleged refusal to comply with an existing court judgment and his purported breach of the Code of Conduct for Public Officers. The lawyer added that the proceedings could include contempt charges, disciplinary measures, and liability for provoking a breach of the peace.

“We strongly advise that you reconsider your untenable stance and comply with the Constitution and extant judicial orders,” Numa added.

The dispute follows a letter from Acting Clerk to the National Assembly, Yahaya Danzaria, informing Akpoti-Uduaghan that she could not resume her duties while her suspension case remained in court. Danzaria, acting in Ogunlana’s absence abroad, stated that her return would require either a Senate resolution or the completion of judicial proceedings.

Although the Senator had notified the National Assembly of her intention to resume after her six-month suspension, sources told Premium Times that the Senate may still block her return when lawmakers reconvene on September 23, citing concerns that the issue remains sub judice.

In her lawyer’s letter, Akpoti-Uduaghan accused Ogunlana of overstepping his constitutional authority, stating: “As Clerk of the National Assembly, you are not an elected member of the Senate. Your functions are purely ministerial: to record, transmit, and implement decisions duly made by the Senate or directed by the courts. To the best of our client’s knowledge, no Senate resolution exists extending our client’s suspension or imposing any new sanction for the same alleged misconduct.

“Your letter fails to disclose on whose directive you purported to act. By assuming powers you do not possess, you have acted ultra vires, and placed both yourself personally and your office in contempt of the Constitution and binding judicial orders.”
