The Federal Government has taken legal action against the 36 State Governors at the Supreme Court, alleging misconduct in the administration of Local Government Areas (LGAs)

In the lawsuit (SC/CV/343/2024), filed by the Attorney General of the Federation and Minister of Justice, Prince Lateef Fagbemi, SAN, the government seeks:

1. Full autonomy for LGAs as the third tier of government.

2. An order prohibiting state governors from unilaterally dissolving democratically elected local government leaders.

3. Direct funding for LGAs from the Federation Account, as per the Constitution, rather than through joint accounts created by governors.

4. An end to the practice of appointing Caretaker Committees to run local governments, which contravenes the constitutional democratic system.

5. An injunction restraining governors from receiving, spending, or tampering with funds meant for LGAs when no democratically elected local government system is in place.

The government’s 27 grounds for the suit emphasize that Nigeria’s federal system, established by the 1999 Constitution (as amended), requires the President and other officials to uphold and implement its provisions.
